Not even a day after Anna Nicole Smith's death, the legal proceedings surrounding her life will move forward without her. The official autopsy will be conducted this morning which should shed some light on what caused her early passing. In related news, there is an emergency hearing scheduled to decide whether a court-ordered DNA sample can be taken from her body to help determine the biological father of her daughter, Dannielynn.
The hearing is expected to start around 9 a.m. before Los Angeles Superior Court Judge Robert Schnider.
Birkhead's attorney, Debra Opri, said that DNA experts are advising her that to get the best sample they need to obtain some of Smiths's DNA within 48 hours of her death. She also indicated that Birkhead is devastated at Anna Nicole's death and has lost "the love of his life and the mother of his child."
According to a spokeswoman for the hotel where she collapsed, five people were with Smith when she checked in Monday night after arriving from the Bahamas. She had been due to arrive Saturday night for a pre-Super Bowl celebrity poker tournament but delayed her arrival until Monday. When she arrived on Monday, the spokewoman said she was feeling sick and was accompanied by a nurse, a bodyguard, Howard K. Stern and two other unidentified people.
